Terms & Conditions for Sea Maine Vacation Rentals 2021
By making a reservation, you are entering into a rental contract with Sea Maine Vacation Rentals" and therefore agree to and are bound by the Sea Maine Vacation Rentals Terms and Conditions: Known terms "The Property" or "Premise" refers to the home, house, or Property that has been booked via the reservation. "Guest or Guests" the person or persons that have made the booking or reservation.
Minimum Age of Guest Making the Reservation
Security Deposit: A Security Deposit in the amount indicated on your contract. Subject to inspection by Property Manager, the Security Deposit will be refunded within 14 days after Check-out. Guest is responsible for the cost of all damage to the Premises in excess of the Security Deposit. Deductions may be made for the following:
- damage to the Premises (other than normal wear and tear)
- extensive cleaning (above average)
- unpaid charges
- unreturned linens
- excessive occupancy
- postage for returning Guest’s items left behind
- unbagged garbage
- extra cleaning due to smoking within the house (smoking is not allowed on the Premises)
- extra cleaning necessary because of a pet (all pets must be approved as part of this Rental Agreement)
- any other extra costs incurred by owner of the Premises caused by Guest
If the Premises appears damaged upon Check-in, Guest shall inform Property Manager immediately to ensure deductions are not made against Guest's deposit.
Cancellation Policy: If Guest wishes to cancel his/her reservation any amounts paid by Guest will be refunded (less any credit card fees incurred) as follows:
100% if cancelled ON OR PRIOR TO 6 MONTHS FROM THE CHECK-IN DATE
50% if cancelled between 6 MONTHS and 3 MONTHS PRIOR TO THE CHECK-IN DATE
0% if cancelled within 3 MONTHS PRIOR TO THE CHECK-IN DATE
Change of Ownership: Should ownership of the property change hands and the new owner does not continue to rent the Premises, this agreement will terminate, and Guest shall receive a complete refund.
Maximum Occupants: The maximum number of people in the Rental Party allowed at the Premises is indicated in the listing. If this number is exceeded without prior approval from Property Manager, Guest will forfeit the security deposit. No subletting is allowed. The Rental Party shall consist of the Guest and the following persons:
Linens: Sheets, towels, pillows, and blankets are provided with this rental.
Smoking: Smoking is strictly prohibited inside or on the grounds of the Premises.
Pets: No pets are allowed without prior approval from the Property Manager. If approved, the first pet is $100.00, and any pets after this are an additional $50.00 (fifty dollars) per pet. Damages from pets with be taken out of your security deposit. If the damages are equal to more than your deposit the property manager and owner will work with you to agree upon an appropriate price to repair said damages.
Localized Construction: Just like any regular neighborhood, from time to time without the knowledge of Sea Maine Vacation Rentals, other owners, homeowner association, or utilities might start or be undertaking local construction. Sea Maine Vacation Rentals has no ability to affect or intervene in such construction and, therefore, cannot and is not responsible for any actions of other property owners, homeowner association, or utilities.
Noise: Guest shall not cause, nor allow to be caused, excessive noise in or around the property nor interfere with the rights and quiet and peaceful enjoyment of persons owning or occupying properties in the surrounding area. No loud noises are permitted outdoors between 9:00 PM and 8:00 AM.
Fireworks: No fireworks are allowed on the Premises.
House Rules: Guest agrees to abide by any and all house rules, whether promulgated before or after the execution of this Rental Agreement, including but not limited to, rules with respect to noise, smoking, odors, disposal of refuse, parking, putting nails in walls, hanging blinds, racks, or shelving, removal of or moving furniture.
Access: Guest shall allow Property Manager reasonable access to the Premises for purposes of repair and inspection.
Utilities: Utilities are included with the rental (electricity, heat, cable, internet). Utility charges above average will be the responsibility of Guest.
Condition of the Property: All electrical, plumbing, and appliances should be in working order. The failures of operation of certain extra amenities, such as TVs, cable, games, or the Internet and Wireless (Wi-Fi) service, are not a basis for any refund. Sea Maine Vacation Rentals will make every effort to have these items repaired but does not guarantee that they will be repaired during Guest’s occupancy. When you arrive, if you find that the house has not been cleaned to normal standards, please notify Sea Maine Vacation Rentals immediately. We will do our best to have relevant tradesmen attend to the problems. The team may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. Guest shall return the Premises to Property Manager at the end of the Term, such that the Premises are in the same condition, reasonable wear and tear excepted.
Ordinances & Statutes: Guest shall comply with all the statutes, ordinances, and requirements of all municipal, state, and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the Premises. Guest agrees to comply with any federal, state or local restrictions or orders imposed by governments with regard to COVID-19, including any stay at home restrictions, self-quarantine, testing or other requirements imposed on visitors arriving to the State of Maine and/or for the use of lodging.
Reasonable Efforts of Property Manager: Property Manager shall not be liable for any failure or delay in performing duties imposed in this Rental Agreement as long as Property Manager makes reasonable efforts under the prevailing circumstances to perform these duties.
Successors & Assigns: This Rental Agreement shall be binding upon and insure to the benefit of the respective heirs, successors, and assigns of Property Manager and Guest.
Indemnification: Guest agrees to indemnify and hold harmless the owner of the Premises and Property Manager and their representatives from any and all liability for any loss or damage whatsoever including but not limited to any claim, action, cause of action or other demand for personal injury or damage or loss of property which is made, incurred or sustained by Guest or any invitee of Guest arising out of, related to or in connection with the rental of the Premises unless the loss or damage is solely the proximate result of gross negligence of the owner or Property Manager.
Supplies: An initial supply of toilet paper, paper towels, trash bags and cleaning items will be supplied.
Trash: Weekly trash pick-up is included. If additional trash pick-up is required, Guest shall contact Property Manager. The additional trash pick-up with be added per bag
Arrival and Departure: Check-in time is 4:00 pm or later. Check-out time is no later than 10:00 am. Property Manager has limited time and resources to properly clean the Premises for the next guest. The fee for late check-out is $200 unless prior arrangements have been made. No refunds will be given for early departures or late arrivals.
Departure and Cleaning: Please leave the house as you found it. Used towels should be placed in a pile in one bathroom or laundry room. Dishes should be cleaned or placed in dishwasher and run. Please take all food out of the refrigerator and put bagged trash in bins provided. The Premises will be thoroughly cleaned before and after your stay. Housekeeping duties during the rental are the responsibility of the Guest. Upon request, Property Manager can make arrangement for additional housekeeping during your stay at an additional charge.
Personal Items Left Behind – Lost and Found
Sea Maine Vacation Rentals is not responsible for any lost or personal items left behind at the Property. In the event, a guest may have left a personal item behind in the Rental Property. Sea Maine Vacation Rentals will do its best to locate it; however, are not responsible for any losses. If the item is found, the Guest will be advised and given the contact details of a local company that specializes in collecting and mailing package deliveries. The Guest will be responsible for arranging collection, shipment, delivery, and any other cost incurred. Unclaimed items will be kept at our office no more than seven calendar days from the Guest's departure date. Any unclaimed items may be donated to charity or disposed of after the 7-day period. The reservation holder must present a valid identification document to pick the item up or to have it delivered. In case of a third party is involved, the reservation holder must send a written authorization with the full name of the person who will be handling the process or pick up.
Optional Travel Insurance
Travel Insurance is offered through several third-party providers. The cost and coverage of the travel insurance are respective to the third-party company. It is the Guest's responsibility to arrange appropriate comprehensive travel insurance to cover risks including, but not limited to, medical treatment, accidents, repatriations, and cancellation/curtailment. Sea Maine Vacation Rentals highly recommends guests purchase trip insurance at the time of booking or at least 45 days prior to the reservation if concerned about possible interruption or cancellation of the trip.
Payment Terms: Upon receipt of a signed Rental Agreement, Property Manager will email Guest an invoice for payment via our payment services. This Rental Agreement is contingent on Property Manager’s receipt of the payment. You are agreeing that all rental monies are subject to the cancellation policy.
Any additional charges incurred during your stay will be adjusted and settled up with the return of the security deposit or additional invoices if necessary.
